Alternative Dispute
Resolution is very much supported by the current government as a means
of preventing the parties needing to resort to the court process.
Mediation is
most commonly used in family law. Mediation is a confidential process
providing a supportive and professional forum in which couples meet
to discuss and deal with issues arising out of separation and divorce,
with the assistance of a neutral, impartial third party who does
not advise. Mediation is not conciliation but provides an alternative
to the more traditional court procedure.
